Conditions

The following general terms and conditions of use apply to the business relationship between Lemm Pacher Sports GbR, Kupferstraße 1, 65428 Rüsselsheim (hereinafter referred to as LEGEA – Lemm Sports GbR) and the customer. Lemm Pacher Sports GbR does not recognize deviating conditions of the customer, unless Lemm Pacher Sports GbR has expressly agreed to their validity in writing.

§ 2 Prices

(1) Our prices are subject to change. The prices listed on our website are subject to change without prior notice.

By placing the order, the customer agrees to our payment and terms of delivery agreed.

(2) The prices are ex Rüsselsheim plus postage and packaging, including statutory VAT.

(3) In the case of deliveries abroad, we reserve the right, in accordance with the applicable statutory provisions, to refrain from reporting VAT.

(4) Club discounts only apply to the regular list prices, promotional items are excluded from discounts.

§ 3 Payment

(1) Our delivery to customers is always made in advance. Deliveries abroad only against advance payment!

(2) The purchase price is due immediately after order confirmation without deduction.

(3) The customer is in default without further explanation on the part of Lemm Pacher Sports GbR 14 days after delivery of the goods if he has not paid. The consequences of default are based on the statutory provisions.

(4) If the customer is in default of payment, any discounts or other price reductions agreed with the customer are no longer valid. In this case, the customer must pay the full purchase price.

(5) The goods remain the property of Lemm Pacher Sports GbR until full payment has been made, or in the event of resale, the claim against third parties is transferred to us (extended retention of title).

§ 4 Delivery / Dispatch

The delivery takes place within Germany and in countries of the European Union and exclusively according to our general terms and conditions. A postage fee is to be borne by the buyer, which may depend on the order value and quantity as well as the location to which delivery is to be made.

§ 5 Conclusion of contract

Lemm Pacher Sports GbR is not obliged to perform in the event of non-availability. However, a contract is concluded and thus a contractual commitment for the individual services if Lemm Pacher Sports GbR has confirmed the customer's order in text form by letter/fax or e-mail.

§ 6 Right of Exchange/Right of Withdrawal

The customer can return the goods received without giving reasons within 14 days by return/cancellation. The period begins at the earliest with the receipt of the goods and this instruction. The timely dispatch of the goods or the revocation is sufficient to meet the deadline. In any case, the return is at the expense and risk of the provider. The return must be sent to the company address stated on the invoice.

Prerequisite for the exchange or return of the goods is perfect condition and original packaging.

Custom-made products of all kinds as well as labeled or flocked items are custom-made products and therefore non-returnable.

The delivery times are non-binding. Claims for damages due to non-performance are generally excluded.

§ 7 Technical and design deviations

We reserve the right to make design changes that are necessary for production reasons. Color tones can often only be reproduced to a limited extent for technical reasons. Complaints about this are excluded.

§ 8 Licenses and Copyrights

The client assures that he is in possession of all licenses, in particular copyrights, required for the treatment and processing as well as purchase and sale by the contractor and releases the contractor from all claims asserted by third parties due to the violation of such rights . If the above assurance turns out to be inaccurate, for whatever reason, the client undertakes to compensate for any damage incurred as a result, as well as license fees, reimbursement of expenses, in particular costs of legal prosecution, as well as extrajudicial and judicial costs to be reimbursed. By placing an order, the customer accepts this assurance.

Otherwise a framework agreement is necessary.

§ 9 Fulfillment

Lemm Pacher Sports GbR reserves the right to work with third parties to fulfill its obligations as a seller.

§ 10 data protection

The customer agrees that his order processing data will be stored electronically.

Lemm Pacher Sports GbR expressly assures that no personal data will be passed on to third parties for advertising purposes.

§ 11 Jurisdiction

Place of jurisdiction for all legal disputes is Darmstadt. It is only the law of the Federal Republic of Germany.

Section 12 Partial Invalidity

If one provision is ineffective, all other provisions remain valid.
